  • Notes
    • A Bastardy Order relating to his birth was issued. Bastardy bonds were the equivalent of what is now known as a maintenance order. These orders were issued, against the fathers of illegitimate children, after being sought by the Overseers of the Poor to save the parish poor law funds. The mother of the illegitimate child was examined by the magistrate and made to reveal the father if she wanted parish relief. Mothers could also be made to pay if they did not keep and nurture the child.

      FC109/G4/22 - 9 July 1823

Details of a Bastardy Order relating to the birth issued against Robert and Mary are as follows.

      SUFFOLK to wit

The order of Edward Moir and Robert Newton Shawe Esquires Two of his Majesty's Justices of the peace in and for the said County, One whereof is of the Quorum, and both residing next unto the Limits of the Parish Church within the Parish of Kettleburgh in the said County, made the ninth day of July in the year of our Lord One Thousand Eight Hundred and twenty three concerning a male Bastard Child, lately born in the House of Industry at Melton in the said County on the body of Mary Couzins single woman.

WHEREAS it hath appeared unto us the said Justices, as well upon the complaint of the Churchwardens and Overseers of the Poor of the said Parish of Kettleburgh as upon the Oath of the said Mary Couzins that she the said Mary Couzins on or about the Thirteenth Day of June now last past, was delivered of a male Bastard Child in the said House of Industry and that the said male bastard Child is actually become chargeable to the said Parish of Kettleburgh and thereby to the Guardians of the Poor within the Hundreds of Loes and Wilford in the said County of Suffolk; and further that Robert Carr otherwise Fairweather of Parham in the said County Labourer did beget the said Bastard Child on the Body of her the Mary Couzins and whereas the said Robert Carr otherwise Fairweather hath this day appeared before us, but hath not shewn any cause why he should not be adjudged the reputed Father of the said Bastard Child,

We therefore, upon Examination of the Cause and Circumstances of the Premises, as well upon the Oath of the said Mary Couzins as otherwise, do hereby adjudge him the said Robert Carr otherwise Fairweather to be the reputed Father of the said Bastard Child. And we do also adjudge that the said Bastard Child was born in the said House of Industry at Melton aforesaid And therefore we do order, as well for the better Relief of the said Parish of Kettleburgh as for the Sustentation and Relief of the said Bastard Child, that the said Robert Carr otherwise Fairweather shall and do forthwith, upon Notice of this our Order, pay or cause to be paid to the overseers of the Poor of the said Parish of Kettleburgh to and for the use of the said Guardians of the Poor of the said Hundreds the Sum of forty shillings for and towards the Lying-in of the said Mary Couzins and the Maintenance of the said Bastard Child, to the time of making this our Order. And also the further Sum of eighteen shillings and sixpence for the expences attending the taking and apprehending of the said Robert Carr otherwise Fairweather

And we do also hereby further order, that the said Robert Carr otherwise Fairweather shall likewise pay, or cause to be paid to the said Overseers of the Poor of the said Parish of Kettleburgh to and for the use of the said Guardians of the Hundreds aforesaid, for the time being, the Sum of one Shilling and three pence Weekly and every Week, from the present Time, for and towards the Keeping, Sustentation, and Maintenance of the said Bastard Child, for and during so long Time as the said Bastard Child shall be chargeable to the said Parish of Kettleburgh and thereby to the said Guardians of the Poor within the said Hundreds.

And we do further order the said Mary Couzins shall also pay or cause to be paid to the said Overseers of the Poor of the said Parish of Kettleburgh to and for the use of the said Guardians of the Hundreds aforesaid, for the Time being, the Sum of ninepence Weekly and every Week, so long as the said Bastard Child shall be chargeable to the said Parish of Kettleburgh and thereby to the Guardians of the Poor within the said Hundreds, in case she shall not nurse and take care of the said Child herself. GIVEN under our Hands and Seals the Day and Year first above-written

Robert CARR otherwise FAIRWEATHER paid 2 Pounds on account. Quite a bit of money for a labourer in those times!

During the pregnancy of Mary, Robert formed another relationship with another young woman Thirza HARSUM from Parham. This also resulted in the birth of a child. A daughter named Pamela Carr HARSUM born 1823 in Parham. Another Bastardy Order was issued in Parham 29 January 1824 and Robert was ordered to pay one shilling and Thirza nine pence per week to the Poor Law Overseers. Robert, still using the name CARR and Thirza decided to marry and this event took place 10 February 1824. Pamela presumably remained with Robert and Thirza, thus saving them the payments to the Poor Law Overseers. In 1836 Thirza who was now using the name FAIRWEATHER, dies as Thirza FAIRWEATHER.

Sometime later, the widower Robert CARR married the widow Amelia RACKHAM in Parham and they settle down to married life. The information found in the 1841census for Parham shows them living with Joshua and John RACKHAM, Amelia's two sons. Joshua would eventually marry his stepsister Pamela Carr HARSUM. Amelia died in Parham 12 July 1851 aged 60 years.

Robert died 17 July 1853 in Parham, District of Framlingham at age 59 years. Cause of death was Gangrene of the leg (5 months) and Emphysema (8 days). The informant was Robert's younger sister Martha NOBLE who was present at his death. She made her mark on the death registration 18 July 1853 Number 24. His name at death was the same as at birth FAIRWEATHER.
