Notes - SATURDAY, AUGUST 4, 1855.
ANOTHER ATTEMPT AT MURDER.
James Western, 47, and James Western, 21, were in- for cutting and wounding William Connibeer, at Tolland, with a hook, with intent to kill and murder him..
Mr. Prideaux prosecuted; the prisoners were undefended.
George Ward., laborer, stated: I work for Mr. Bruford, at Tolland; on the 7th of May last I was directed to watch in a barn belonging to Mr. Bruford; Connibeer was directed to watch with me; on that night I heard a man come up to the door; the bolt came out of the door, and fell upon the floor, and the door came open; a man came in at the barn door, and went to the place where the wheat was kept, and having filled a sack, he took it outside the barn; as the man was going out of the door, I went up to him and put my hand on his shoulder, which was the elder prisoner; I knew him, and said "James you are my prisoner;" I dragged him on towards my master's house, and after we had got about five paces, I saw the younger prisoner coming; Connibeer was walking close after me, and I said to him, "look out, there's someone coming"; at that moment Connibeer turned round, when he was immediately knocked down by the younger prisoner ; Connibeer had a gun, but as soon as he fell, the younger prisoner laid hold of it, and it went off; they had a struggle, and the gun was wrested front Connibeer, and the other beat him with the butt end of it about his head; whilst beating Connibeer, the younger prisoner said, "I'll kill you, you b- -," and Connibeer was left for dead; The younger prisoner than ran after me and said " I'll do the same to you, you b- - ";he then made a blow at me, but struck his father; I let go my prisoner, and they both ran away, and I then went to look after Connibeer, who, was bleeding like a bullock..
Mr Prideaux intimated that there was no case against the elder prisoner, and he was ordered to leave the dock..
The Prosecutor, William Connibeer, was next called; but he could recollect nothing that occurred after receiving a blow in his head, which was, he said, covered with wounds..
Dr. Edwards, of Wiveliscombe, stated: On the 18th May last, I was called to attend on Connibeer, and found him partly insensible; on removing a handkerchief from his head, which was saturated with blood, I found a cut six inches in length, from the scalp to the bone, and the bone was fractured; in the back part of the head there was a wound two inches in length, close to the bone, but there was no fracture here; there were six other wounds, which, I have every reason to believe, were caused by the butt end of a gun. Connibeer is still suffering from the effects of his injuries, and is now under my care..
The Prisoners were traced, and in their house was found a hook, covered with blood, which had undoubtedly been used to break open the barn door, and was the weapon which had been used by the younger prisoner in his first attack upon Connibeer..
In his defence, the younger prisoner said that Connibeer shot at him with the gun..
There was also a charge against the prisoners of stealing three bushels of wheat, value 1.8s. from the barn, at the time of the above named charge, to which they pleaded Guilty..
The elder prisoner was again placed in the dock with his son, and the Jury having returned a verdict of Guilty against the younger prisoner for an attempt at murder, the learned Judge said he had been convicted of an offence for which his life was forfeited; but having a regard for his youth, he would recommend his Case to the proper quarter; he must however, make up his mind to pass the remainder of his life in a foreign country. As regards to the elder prisoner, after being the second time convicted on such a charge as He had pleaded guilty to, penal servitude was generally inflicted; he no doubt, his Lordship thought, was the cause of the trouble brought, upon his son; but he would deal more mercifully with him. He then passed a sentence of one year's hard labour..
